It’s official! TPS for Venezuelans has been extended until Oct. 2026

DORAL, FL – The 2023 TPS for Venezuelans has been officially reinstated beginning April 3, 2025, and ending on October 2, 2026, following an order issued by federal judge Edward M. Chen. 

On Monday, Chen put a pause to the previous plan of the Trump administration to end the Temporary Protected Status for more than 300,000 Venezuelans in the United States, rolling back the decision of his predecessor, Joe Biden, of extending the program for 18 months.

Now, the U.S. Citizenship and Immigration Services (USCIS), as well as the Department of Homeland Security (DHS) have both agreed to comply with Chen’s order and even issued a statement confirming the extension of the TPS. 

The announcement comes just a week before it was scheduled to expire, on April 7, which would have left thousands of law-abiding Venezuelans in the air. But with this new decision, there’s even hopes for the TPS to be renewed after meeting the 18 months mark. 

“Pursuant to the order -Chen’s-, the department will revert to the Federal Register notice that was published on Jan. 17, 2025,” it can be read in USCIS website.

DHS’s Federal Register has been already posted online, and it also says existing TPS beneficiaries who wish to extend their status through October 2, 2026, must re-register during the re-registration period described in the notice.

Judge Chen said on Monday in his ruling that the action taken by Homeland Security Secretary Kristi Noem, who reversed protections for Venezuelans, “threatens to inflict irreparable harm on hundreds of thousands of persons whose lives, families, and livelihoods will be severely disrupted, cost the United States billions in economic activity, and injure public health and safety in communities throughout the United States.”

He also said his order applies nationally, while he gave the government one week to file notice of an appeal. Meanwhile, the Trump administration already submitted a 14-page document outlining why Judge Chen’s order is inappropriate. The document cites Chen’s lack of authority to overrule Noem’s order as one of the reasons.

The administration has also announced it was revoking temporary protections for more than 530,000 Cubans, Nicaraguans, Haitians, and Venezuelans who have come to the U.S. since October 2022 through humanitarian parole. Their two-year work permits will expire April 24.
