Time for Good Immigration Reform.

The time has finally come for meaningful immigration reform. It is my hope it will include the legalization of undocumented individuals in the U.S. and updated immigration laws that meet the demands of our country.
Our firm has actively participated in many lobbying events in the past 10 years in support of responsible reform. Finally, the Obama Administration and Congress are taking a serious look at immigration reform. The Senate has established a bipartisan group of senators looking at the issue. The group includes Marco Rubio (D – Florida), John McCain (R – Arizona), Lindsey Graham (R – South Carolina), Michael Bennet (D – Colorado), Jeff Flake (R- Arizona), Charles Schumer (D – New York), Richard Durbin (D- Illinois) and Robert Menendez (D – New Jersey). The House is also working on reform with various representatives leading this task, among them our Congressman Mario Diaz Balart and Ileana Ross Lehtinen. President Obama also has a proposal for immigration reform.
Given that both branches of Congress and the President have all moved immigration to the top of their list, and the country can’t wait anymore for immigration reform, lets all aim for a good immigration law to be implemented as the outcome. Lets hope our government can work as a team, and take this moment as an opportunity to work together, rising above political parties and branches of government to allow for a productive exchange of proposals and result in a comprehensive immigration reform that addresses the existing and future immigration needs of our country.
The reality is that we have at least 11 million undocumented individuals in the US who are part of our communities, and part of our work force. We have families that are being separated and their standard of living and safety threatened when this happens. We have economic needs that are met by the influx of foreigners. We have a border that will always need to be secured, and we have current employment laws that are constantly broken for the reasons cited above.
What is the solution? Many proposals are expected, and the basic issues that should be addressed must include a path to residency to DREAMERS. These are individuals who entered the US as minors, have been educated with US resources, and are currently in the US with no status.
US citizens or residents who have a family member who is or has been deported, should be given an opportunity to remain in the U.S. Existing laws have taken away the ability for immigration judges to make this determination on case-by-case basis. Factors such as family ties, moral character, rehabilitation, employment history should all be assessed by the court and the judge be given the discretion to balance all these factors, impact of a deportation of this individual to U.S. citizen or resident family members and be able to grant residency if appropriate.
Employers in labor-intensive industries such as agriculture, construction and hospitality, should be given the opportunity to petition for undocumented individuals who are currently in the US. A new visa category for future employment needs of these industries should be created, that allows for the influx of foreigners to work in these fields, with renewal options.
Employers can petition for key employees, but many times the waiting of these visas are more than 5 – 7 years. Remove the quotas, our best and brightest employees are going to other countries and leaving the US behind in technology advances, and other fields.
While our government debates and reaches an agreement, what can you do?
You can help make this happen. You can join an immigration coalition, a religious group, or any organization where you can volunteer your time to make this happen. Unite forces and advocate for good law. Call your representatives and ask everyone you know to call them too.
If you are undocumented you can also start gathering your documents that prove when you arrived in the US – entry document, family ties, payment of taxes if any.
It’s important that people speak to knowledgeable and reliable sources to help them with their immigration status. Our law firm has been helping people realize their American dreams for nearly 20 years.

Finalmente, la administración de Obama y el Congreso están seriamente trabajando en una reforma de inmigración. Ya que todas las ramas del gobierno tienen inmigración como prioridad y el país no puede esperar mas por una reforma de inmigración, vamos todos a colaborar para que una buena ley de inmigración sea implementada. Esperemos que nuestro gobierno pueda trabajar como un solo equipo y tomen esta oportunidad para trabajar unidos, superando las diferencias de los partidos políticos y de las ramas del gobierno para poder obtener un intercambio productivo de propuestas que resulten en una reforma de inmigración integral que aborde las necesidades de inmigración existentes y del futuro.
La realidad es que tenemos por lo menos 11 millones de individuos indocumentados en los Estados Unidos que forman parte de nuestra comunidad y fuerza laboral. Tenemos familias que están siendo separadas y su seguridad y estándar de vida amenazada cuando esto sucede. Tenemos necesidades económicas que los extranjeros cubren. Tenemos fronteras que siempre necesitaran ser cuidadas, y tenemos leyes laborales que son quebrantadas constantemente por estas mismas razones.
Cuál es la solución? Se esperan muchas propuestas y los temas básicos estas deben incluir son: Una vía de residencia para los DREAMERS. Estos son individuos que entraron a los Estados Unidos siendo menores de edad, que han sido educados con recursos de este país y que actualmente están en los Estados Unidos sin status.
También hay americanos o residentes que tienen familiares que están en proceso de deportación o han sido deportados, y ellos deberían tener la oportunidad de quedarse en los Estados Unidos.
Las leyes que existen actualmente le han quitado la discreción a los jueces de inmigración de poder hacer determinaciones basadas en cada caso. Factores como lazos de familia, carácter moral, rehabilitación, historia de empleo, deben ser evaluados por la corte y el juez debe tener la discreción para balancear todos estos factores, el impacto de la deportación del individuo a los familiares que son ciudadanos o residentes, para poder conceder residencia, si es apropiada.
A los empleadores en industrias con exigencias laborales como la agricultura, construcción y hotelería y turismo, les deben dar la oportunidad de solicitar a individuos indocumentados que están ya en los Estados Unidos. También una nueva categoría de visa debería ser creada para las necesidades futuras de estas industrias, permitiendo la entrada de extranjeros para trabajar en estos campos, con opciones de renovación.
Empleadores pueden hacer peticiones para sus empleados esenciales, pero muchas veces estas visas se demoran entre 5 a 7 años. Remuevan las cuotas para las visas, nuestros mejores y más brillantes empleados se van a otros países y están dejando a los Estados Unidos atrás en avances de tecnología y otros campos.
Mientras que nuestro gobierno llega a un acuerdo, que podemos hacer?
Usted puede lograr que esto pase. Se puede hacer miembro de alguna coalición, un grupo religioso o una organización donde pueda servir de voluntario para contribuir a que una buena reforma pase. Llame a su representante y pídale a todos los que conozca que hagan lo mismo. Si Usted es indocumentado, puede también empezar a recopilar documentos para probar su estadía en Estados Unidos: documento de entrada, lazos familiares, prueba de pago de impuestos.
Es importante que se asesore con personas informadas que lo ayuden con su status de inmigración. Nuestra firma ha estado ayudando a individuos a realizar su sueño americano por casi 20 años.
