An Eight hour long session with long heated discussions. Summary of October Council Meeting.
The more than one thousand pages of supporting documents in the agenda package anticipated a long meeting. And a packed council chamber ensured the heated debate, with many citizens requesting their right to address the Council.
A standing only crowd attended the afternoon session of the Council Meeting and there was a long line for public comments. However, one could only wish it was like that every month, not only when there are issues in the community that require immediate attention.
Of all the items from the agenda worth sharing, below is a recap of highlights from the City of Doral October Council Meeting
NW 36/ 41 Street Beautification Master Plan
The presentation of preliminary proposals for beautification of 41 street covered aspects such as design of edges, thresholds and core that give character and identity to what is the main corridor of the City. The Council received an explanation of the status and future steps were recommended. Although it is a project that started back in 2004 when the city was established, it was approved by consensus that staff makes a reevaluation of the phases in order to commit on advancing on the implementation in a cost effective manner. It should include consideration of strategies to underground utilities using impact fees charged to builders as funding for the project.
Farmers’ Market Permit renewed
There is a study undergoing through the planning department regarding new locations for the market as it is becoming a year round event. In the meantime the permit was extended until February 2015 with a 3:1 approving vote.
Road Safety Campaign
Councilwoman Ruiz requested a presentation to obtain consensus to promote within the city the “Super Road Safety” campaign. It was developed by Doral resident Leonardo Naranjo and includes strategies and materials to educate the community on road safety awareness and accident prevention, focused on the younger members of the citizenry. Councilwoman Rodriguez Aguilera cosponsored the presentation and all Councilmembers agreed to put Mr. Naranjo in touch with the City Manager in order to move forward with the initiative.
Doral Park Residents concerns on Palm Tree planting:
Mr. Morgan Levy addressed again the Council in representation of an organized group of Doral Park communities and concerned citizens affected by the installation of the palm trees in front of their houses by the Trump Doral Resort. Neighbors supported his remarks by wearing stickers stating “Respect my vote” and voicing “Donald Trump, take down this walls of trees!”
Their main request is for the City to assist on solving the issue in an amicable manner with the owners of the Resort, in particular by helping the group of citizens to meet in person with Mr. Donald Trump to discuss the issue that has safety, environmental and economic impact for the residents.
Although all Councilmembers ensured residents on their commitment to look out for the best interest of the community and to stand up for their rights, the City Attorney recommended that the communities are represented by legal counsel, as this is an issue that is going to take a team to be resolved.
Ordinance #2014-39 Eligibility for benefits for Domestic Partners of City Employees
On the September Council Meeting there was unanimous consent to instruct staff on including Domestic Partners coverage on the discussion of benefits for employees of the City. It was supported then because “progressive organizations have that benefit for their employees”. However, when the passing of the ordinance to modify the code and include the extension of benefits was up for discussion on First Reading in October, it ignited a debate that included religious leaders and public arguing that passing such an ordinance was not honoring “godly and family values”, that it should not be the “constituents business” to finance the “sexual preference” of the employees and that “institutions should be respected”, among other comments.
On the other hand, activists of LGBT rights and general public commented that 16 municipalities in Miami-Dade offer that benefit to their employees, that it does not only protect same-sex partners but heterosexual partners; that it is legal and not immoral; that it provides coverage and protection for the families of the employees that care for the wellbeing of the community. It was even brought up the issue of “separation of State and Church”.
Mayor Boria moved to reconsider the unanimous vote taken last month that requested the creation of the ordinance and the motion passed 3:2, Ruiz and Fraga being the nays.
After two hours of discussion, it was decided to defer the item until a later date yet to be defined, waiting for the City Attorney to provide the Council with the current legal details surrounding domestic partnership issues. The motion passed unanimously. It was almost 10:00 p.m.
Recognitions presented. One rejected
Councilwoman Ruiz received recognition by the American Cancer Society Relay for Life, for her work for the success of the event in 2014 and her tireless and continuous support to the cause and the organization over the years.
Councilwoman Rodriguez Aguilera was recognized by the ”Safespace Foundation” for her commitment on the fight against domestic violence and the promotion of the Purple Ribbon Campaign and the Domestic Violence Awareness month.
Mr. Matthew Dietz, the attorney that provided counsel and support on the development of the Ordinance for Assistance of Service Animals was going to receive recognition. However, after having witnessed the lengthy discussion about the Domestic Partners Ordinance, Mr. Dietz respectfully declined receiving the certificate stating that as someone who has advocated for equal rights, he could not accept a certificate when there is any group of members of this community that do not receive equal rights recognition.
Meeting was adjourned past midnight.

Resumen de la Reunión de Concejo Municipal de Octubre

Era de esperarse una larga reunión; el paquete de documentos de soporte para la agenda contenía más de mil páginas. Y la Cámara a casa llena aseguraba debate, con la presencia de muchos ciudadanos solicitando derecho de palabra.
La sesión vespertina del Concejo Municipal de Doral estuvo muy concurrida. Solamente quedaba espacio de pie en la Cámara y en la Sala de Prensa. Sería ideal contar con tal cantidad de ciudadanos participando regularmente.
De un total de 59 puntos de agenda, a continuación se resumen los asuntos más resaltantes tratados en la Reunión de Octubre.
Plan Maestro de Embellecimiento Calle NW 36/ 41
La presentación de las propuestas preliminares para remodelación y embellecimiento de la calle 41 incluyó la descripción de aceras, umbrales de entrada e islas centrales que identificarán la calle principal de la Ciudad. El Concejo recibió una explicación de la situación actual del proyecto y los próximos pasos recomendados. Aun cuando esta idea data del año 2004, cuando se estableció la ciudad, se aprobó por consenso que el personal realice una reevaluación de las fases para comenzar a avanzar en la realización del proyecto de una manera oportuna y rentable. Deberán considerarse en el plan estrategias para la instalación de cableado subterráneo y la utilización de los montos recaudados por concepto de “impact fee” para cubrir ese costo.
Renovado el permiso para el Mercado
Se encuentra en proceso un estudio por parte del departamento de planificación para la reubicación del mercado en otra localidad dentro de la ciudad, pues se ha convertido prácticamente en un evento que dura todo el año. Mientras este estudio se culmina, el permiso de operación fue extendido hasta Febrero 2015 con una votación 3:1
Campaña de Seguridad Vial
La Concejal Ruiz solicito la presentación sobre Seguridad Vial para lograr el consenso en la realización dentro de la ciudad del programa “Super Road Safety”. Esta idea fue desarrollada por el Sr. Leonardo Naranjo, residente de Doral, e incluye estrategias y material para educar a la comunidad en medidas de protección y seguridad vial, enfocándose en educar a los miembros más jóvenes de la ciudadanía.
La Concejal Rodríguez Aguilera fue copatrocinador de la presentación y todos estuvieron de acuerdo en implantar esta iniciativa en la comunidad con el apoyo de la Ciudad.
Residentes de Doral Park afectados por plantación de Palmeras alrededor del Campo de Golf
El Sr. Morgan Levy se dirigió nuevamente al Concejo en esta oportunidad, representando a un grupo organizado de comunidades de Doral Park y otros ciudadanos afectados por la instalación de Palmeras en frente de sus casas por parte del Trump Doral Resort. Gran cantidad de vecinos apoyaban esta causa, portando letreros de “Respeten mi voto” y voceando “Donald Trump, ¡quita esos árboles!”.
La principal solicitud de estos residentes consiste en que la Ciudad les apoye en la resolución amigable de esta situación con los dueños del Resort, ayudándoles a reunirse en persona con el Sr. Trump para discutir el asunto que tiene impacto de seguridad, económico y ambiental para los residentes de Doral Park.
Aun cuando todos los Concejales y el Alcalde aseguraron a los residentes su compromiso solidario de velar por los intereses y derechos de la comunidad, el Abogado de la Ciudad recomendó a las comunidades afectadas que solicitaran también apoyo legal privado, para lograr en equipo la solución de este asunto.
Ordenanza #2014-39 Elegibilidad para beneficios para las Parejas Domesticas de los Empleados de la Ciudad
En la Reunión de septiembre, hubo consenso en la decisión de incorporar en la cobertura de beneficios a las Parejas Domesticas de los empleados de la Ciudad. Uno de los argumentos de soporte en ese momento fue “organizaciones progresistas ofrecen ese beneficio a sus empleados” y todos votaron a favor en ese momento.
Sin embargo, cuando en Octubre se hace la Primera Discusión de la ordenanza que modificaría el código para extender estos beneficios, se inició un debate que incluyó líderes religiosos y publico argumentando que aprobar esa ordenanza no honraría “valores piadosos y morales”, que los “contribuyentes no tienen que financiar las preferencias sexuales de los empleados” y que “las instituciones deben ser respetadas” entre otros comentarios.
Por otro lado, activistas a favor de los derechos de la comunidad LGBT y público en general comentaron que 16 municipalidades de Miami Dade y muchas corporaciones ofrecen ese beneficio a sus empleados; argumentaron también que es un beneficio que no solamente protege a parejas del mismo sexo sino a parejas heterosexuales de hecho; que es legal y no es inmoral; que provee cobertura y protección a las familias de los empleados que trabajan para beneficio de la comunidad. Incluso alguno de los comentarios aludió a la “separación de la religión y el Estado.”
El Alcalde Boria pidió la reconsideración del voto unánime obtenido el mes pasado para requerir la creación de la ordenanza. Esa moción paso 3:2 siendo Fraga y Ruiz los “No”.
Luego de dos horas de discusión, se decidió diferir el asunto por tiempo indefinido, hasta que el Abogado de la Ciudad proporcione al Concejo los detalles legales más actualizados con respecto a los asuntos que rigen las uniones de hecho. Esta moción paso de manera unánime. Ya eran pasadas las 10 pm
Entrega de Reconocimientos. Uno de ellos rechazado
La Concejal Ruiz recibió un reconocimiento por parte de la American Cáncer Society por su apoyo constante a la organización y su gran trabajo para el éxito del evento Relay for Life 2014.
La Concejal Rodriguez Aguilera fue reconocida por la Fundación Safespace por su compromiso en la lucha contra la Violencia Domestica y la promoción del Mes de Concientización y la Campaña del Lazo Púrpura por esa causa.
El Sr. Matthew Dietz, abogado que apoyó el desarrollo de la Ordenanza para Asistencia a los Animales de Servicio iba a recibir un certificado de reconocimiento. Sin embargo, luego de presenciar la larga discusión sobre la Ordenanza de las Parejas Domesticas, el Sr. Dietz respetuosamente declinó recibir tal reconocimiento, pues como persona que ha trabajado incansablemente por la igualdad de derechos, no podría aceptar un certificado por parte de una comunidad mientras exista algún grupo de ciudadanos dentro de ésta que no reciba igual atención a sus derechos.
La Reunión culminó pasada la media noche.
